Terms and conditions

In addition to the standard terms and conditions the following additional terms and conditions apply to HiFlows-UK.

Important Information

The parties to HiFlows-UK are the three UK gauging authorities - the Environment Agency (England and Wales), the Scottish Environment Protection Agency (Scotland), and the Rivers Agency of the Department of Agriculture and Rural Affairs (Northern Ireland).

The information and data on this website are the result of work carried out jointly by the parties to HiFlows-UK, and the website contains a subset of the information in the possession of these bodies, so that further information may be available in relation to specific sites. Data and information may be updated and may change.

Stage-Discharge Equations (Rating Curves)

The stage-discharge equations applied within HiFlows-UK are not always the same as those applied in the main hydrometric archives of the gauging authorities. The equations applied in HiFlows-UK have been considered to be the most appropriate for derivation of a flood flow series, and they may not be appropriate for other purposes (e.g. drought flows). Stage-Discharge Equations are also subject to change and improvement as more data is collected or more detailed analyses carried out. In the longer term, it is hoped to consolidate to a more consistent series of rating equations in the various archives.

Intellectual Property Rights

All intellectual property rights in the data and information on this web site are owned by the parties to HiFlows-UK, unless specifically acknowledged, or are licensed from other 3rd party data providers. This site may include mapping data licensed from Ordnance Survey used for setting the website information in its geographical context. Ordnance Survey retains the copyright of this material and it can not be used for any other purpose.

Permitted uses over and above those in the Standard Terms & Conditions

Full Commercial (as defined in the standard T&Cs) internal use rights are granted provided that you do not supply these data or anything either Copy Derived or Process Derived from it to any other person. Please contact us if these permissions are required.

“Copy Derived” means that the derived information includes a copy of the information as a whole or a substantial part of it or that the derived information can be reverse engineered to create a copy of the information or a substantial part thereof and in deciding whether or not information or an information product is Copy Derived it is necessary to look at whether a systematic series of extractions or the product, taken as a series of unit sales, meets the test of being Copy Derived.

Examples of Copy Derived use would be if a third party combined HiFlows-UK information with third party information to create a composite database or if it were incorporated into a data product that includes HiFlows-UK information in its makeup.

“Process Derived” in relation to information means the mechanism by which a derivative requires the physical input of the information into a rules-based process whether or not that process is automated or done by human intervention where the resulting information is not Copy Derived or created as-is from the information.

An example of Processed Derived data would be the model outputs from a computer modelling exercise where HiFlows-UK information has been used in the process to produce these outputs. It does not matter whether the process is automated or not.
